Terms And Conditions:

1 - You are a Guest

Remember, just like everybody else on this website; you are a 'guest'. This means that you must use the website in accordance with (but not limited to) all terms and conditions listed on this page. If you do not accept the terms and conditions for the website, please leave now. It also means that we may ban any user from the website at our discretion. This includes users which pay for a premium account. If you do not follow the terms and conditions, or you do anything that we do not think should be allowed, we can ban you regardless of if you pay for your account or not. If you are banned, and you have a subscription to the website, it is your sole responsibility to cancel the subscription.

2 - Hacking and Scamming is bad!

Hacking and scamming is prohibited! This means that under NO CIRUMSTANCES are you allowed to gain access or attempt to gain access to anybody else's account. This includes but is not limited to trying to get hold of anybody else's password, Attempting to sign in to someone else's account, trying to use the "forgotten password" feature on somebody else's account, and sending e-mails in an attempt to gain login information (which also violates copyright laws as you are using our material to try and fool somebody!) We have undercover accounts operating on the website, and if we find you doing this, we will permanently ban your account, and ban your I.P. Address from our website. We will not give any prior notice to doing this. In addition to this, it is prohibited to try and hijack any forms on the website. This includes but is not limited to forms such as the profile page form, and adoption page form!. We do not keep 13 and under's first name, last name, or country. This is done for a good reason, and any attempt to hijack our forms to change information like this will result in an instant ban should we find out!

3 - Cheating and Spamming is not allowed either!

In Addition to the above, cheating and spamming is also prohibited. Anybody found cheating or Spamming will be permanently banned, and their IP address will be banned. Again we will not give any prior notice to doing this. If you find any form of "glitch" in a game (i.e. something which you can do which was not intended), by using it to your advantage is also classed as cheating and this will result in a permanent ban as well. If you find a glitch in a game, you should immediately report it to us using our Contact Form. Our referral center is a service which we have set up so that you can help us to become more popular. In return we reward you for new sign ups with virtual Battlesnails items. If you send multiple e-mails to any ones e-mail address or spam random accounts which are not your friends you will be banned, as this is also classed as cheating not to mention a nuisance for the people receiving the e-mails.

4) - Remember we are an online community!

In the following section, "offensive" represents any word that is a swear word, racist, sexist, of a sexual nature, that resembles gang slang or resembles the promotion of gangs, is a political, religious or social view or opinion, or is in any way offensive (but not limited to the aforementioned).

1. You are limited to 1 account per person, to ensure that there are enough usernames and snail names for everyone!. If you are caught out with more than 1 account, all of your accounts and snails will be permanently deleted.
2. Anything that you post onto the website whether it be (but not limited to) a user name, snail name, post on a forum or a shop description should be written in English and not contain any material that anyone may find offensive in any way (yes this includes any abbreviations of words too!).
3. Although we will try and keep all profanity and offensive material to a minimum, we cannot guarantee that the content on the website will be free of offensive material. If any material is found, it is added to a database of prohibited words / phrases so that it cannot be used again.
4. We are not a dating service. Any form of romance is strictly prohibited and you will be instantly banned if caught doing this.
5. You must NOT post any material on the website that may relate to you as personal information, This includes (But is not limited to) your address, real name, phone number or school. The internet can be a dangerous place, even on game websites so you should not post any personal information for your own safety.
6. If you are under 13, you must also be accompanied by your parent / carer over the age of 18 during your visit to this website.
7. You must NOT post any links to external websites without contacting us for permission first. You may only post external links after you have had a reply from us, and we have said that we accept. We will only accept links to "fan websites"
8. You must NOT link to any chat rooms, message boards, shout boxes or forums (but not limited to) that are not based on the Battlesnails website.
9. You must NOT post personal information about any other user or yourself on the website, including but not limited to any profile websites
10. You must NOT post any promotions, contests chain letters or any freebies
11. You must NOT post any material (copyright, AND non-copyright) that was created by someone else unless you have written permission. Remember you are liable for all material you post
12. You must NOT link to or place any form of advertisement on the website for a third party commercial websites or businesses
13. You must NOT test our offence filters or try and find an offensive word we have not discovered yet
14. You must NOT post any material on the website that at our sole discretion find unnecessary

Violation of any of the above may result in your account and your IP address being banned. In most cases, posting inappropriate material will result in a warning message being sent first, but under certain circumstances an instant ban may be necessary

5) - The E-mails you receive from us

As default, when you sign up, you understand that your e-mail address will receive mail from us. This includes (but is not limited to) the e-mail you get when you sign up to confirm your e-mail address, special offers from us, third party advertisements (of which you understand that you have no obligation to accept any of these offers) news letters, account notifications and updates. However, you can choose not to receive these e-mails. If you do not wish to receive any e-mail from us, you should visit your "user profile" page, and opt out of the e-mails through the form provided on the page. You may also opt out of receiving e-mails by contacting us through the "contact form", or the Battlesnails Internal Mail. Regardless of if you are opted-in or opted-out of receiving e-mails, you will always receive an e-mail if you or anyone pretending to be you requests a new password or activation code to be sent to your e-mail address. If you receive an e-mail with a new password or activation code that you did not request, you should report it immediately through the Contact Form

6) - The material you post

By posting any material including but not limited to any writing, picture, video, flash or game on our website you understand that you are handing over the copyright for the material to us. We may use the material you post for whatever we want, and we may also modify the stuff which you upload. This includes (But again not limited to) any comments, posts or art work that you create. Basically this means that once you have posted anything on the website or submitted any material to us, we are the lawful owners of the material and we can do what we like with it. You should also take in mind that anything that you post, whether it be on (but not limited to) the forum, or private internal) mail may and will be monitored.

7) - Using our material on your website

All material including (but not limited to) pictures, writing, logos, domain names and media are copyright to Battlesnails. If you wish to use any of our material on your website, you must first contact us using the contact form. Please state what your website address is and what the website will be about. Under most circumstances, we will allow our media to be used on other websites (such as fan sites for example) but will usually request that a copyright notice is placed on the site too. Please do not get caught out, contact us for your specific terms and conditions for doing this on your website! We do not mind people using our material, however we do mind people using it without them first gaining permission from us.

8) - Copyright material

Use of other people's copyright material is strictly prohibited. If you have reason to believe someone is using material that is not theirs, please contact us immediately using the contact form, and please provide an electronic signature (or scanned signature) of the person authorized to act on behalf of the owner of the copyright interest, a description of the copyrighted work that believe has been unlawfully used, along with the location on the website of the material, your name, address, contact number, and age, a statement written by you that you have a good faith that you believe that the disputed work is not authorised, and a statement written by you that states under the penalty of perjury, that all information given is accurate and that you are the copyright owner, or you are authorised to act on behalf of the copyright owner.

Denial of Access to the website

Battlesnails may decide that any individual is banned from accessing the website, at its sole discretion. We do not have to give any form of notice that any individual will be banned.

Selling Battlesnails virtual items / virtual money

It is strictly prohibited for any items or virtual money (but not limited to) to be sold for anything of real value. This includes but is not limited to private transactions between two people, and auction websites. You are also prohibited to selling "the time it took you to get an item or money" in return for anything of real value. Look at it as if you are copying a book, then selling your own copy by selling "the time it took you to rewrite the book". It is copyright and thus not allowed. Any accounts found selling or buying and virtual items including virtual money for anything of real value will be banned. We may at our sole discretion ban any accounts that we believe may have been involved in one of these transactions.

Creating or using 3rd party software

You are not permitted to create or use any third party software that may aid you with the Battlesnails game in any way. This includes but is not limited to account hijackers, auto buyers, and macro programs to aid in combination key presses.

Any subscription payments and donations are non-refundable.

By buying a premium account, you fully understand and will abide by the above terms and conditions, and you also understand that any subscription payments are 100% non-refundable. If you are banned from the website, this is your own fault and you have to pay the consequences. Sorry!

Battlesnails are not responsible for the content that apprears within the website. This includes (but is not limited to) messages sent by users, and on site advertisements from third party companies.
